This Privacy Policy explains what personal data Panama Properties collects when you use our website or work with us, how we use and share it, how long we keep it, and the rights you have over it.

Panama Properties is a licensed real estate brokerage in the Republic of Panama. We are the data controller responsible for the personal data described in this policy.

2. Scope of This Policy
This policy applies to personal data we collect through www.panama-properties.com (the “Website”), our forms, our email newsletter, and our communications with you by email, phone, WhatsApp, video call and in person when you buy, sell, rent or ask about property in Panama. It does not apply to third-party websites we link to.
We handle personal data in line with Panama’s Law 81 of 2019 on Personal Data Protection and its regulations (Executive Decree 285 of 2021), and, where they apply to you, other data protection laws such as the EU and UK General Data Protection Regulation (GDPR).
3. Information We Collect
Information you give us
Contact details such as your name, email address, phone or WhatsApp number and country of residence.
Details about your property search or sale, such as budget, preferred areas, property type, timeline, travel plans and residency goals, including what you enter in our client information form.
Messages, notes and records of calls, video calls and meetings with you.
If you list a property with us: ownership and property details, photos, pricing and documents about the property.
If you go ahead with a transaction: identity documents (such as a passport), proof of address, source-of-funds information and other details we or the professionals involved are required to collect under Panama’s anti-money-laundering rules.
If you create a site member account: your login details and profile information.
Information collected automatically
When you use the Website, we and our service providers automatically collect technical and usage information, such as your IP address, approximate location, browser and device type, pages viewed, links clicked, referring website and the date and time of your visit. This is collected through cookies and similar technologies (see section 6).
Information from others
We may receive information about you from people you ask us to work with, such as your attorney, an immigration lawyer, a mortgage partner or another agent, from people who refer you to us, and from public sources such as Panama’s Public Registry when we check a property.
4. How We Use Your Information and Why
We use personal data only for clear purposes and on a lawful basis:
To answer your enquiries and provide our services, including matching you with properties, arranging viewings, representing you in a purchase or sale and helping after completion. Basis: steps you ask us to take before a contract, and performing our agreement with you.
To introduce you to professionals you ask us to connect you with, such as attorneys, immigration lawyers, mortgage partners, surveyors and property managers. Basis: your request and consent.
To send you our newsletter, new listings and market updates. Basis: your consent. You can unsubscribe at any time.
To run, secure and improve the Website, understand how visitors use it and measure our advertising. Basis: our legitimate interests and, where required, your consent to cookies.
To meet legal obligations, including anti-money-laundering due diligence, record keeping, tax and responding to lawful requests from authorities. Basis: legal obligation.
To protect our rights, prevent fraud and resolve disputes. Basis: legitimate interests and legal obligation.
We do not sell your personal data, and we do not use it for automated decisions that have legal or similarly significant effects on you.
5. How We Share Your Information
We share personal data only as needed for the purposes above:
Service providers that host and run our Website and communications, including Wix.com (website hosting, forms, member accounts and email marketing), Google (analytics and advertising), and Meta (WhatsApp). They process data on our behalf under their own security and privacy terms.
Parties to your transaction, such as the seller or buyer, developers, other brokers, attorneys, notaries and escrow agents, to the extent needed to complete it.
Professionals you ask us to introduce, with your consent.
Listing platforms and partner brokers, if you list a property with us, for the property information needed to market it. We do not publish a seller’s personal contact details without permission.
Authorities, when required by law, court order or regulation, including Panama’s anti-money-laundering supervisors.
A successor business, if Panama Properties is involved in a merger, sale or restructuring, in which case this policy will continue to protect your data.
6. Cookies and Similar Technologies
Cookies are small files stored on your device. The Website uses:
Essential cookies set by Wix to run the site securely, remember your cookie choices and keep you signed in. These cannot be switched off.
Analytics cookies from Wix and Google Analytics, which help us understand how visitors use the Website.
Advertising cookies from Google (including Google Ads and DoubleClick), which help us measure our ads and show relevant ads on other sites.
Where required, we ask for your consent before using non-essential cookies, and you can change your choice at any time through our cookie banner or your browser settings. 7. International Transfers
Our business is in Panama, but our service providers, including Wix and Google, store and process data on servers in the United States and other countries. Our clients also live in many countries. When we transfer personal data outside the country where it was collected, we rely on the protections required by applicable law, such as providers’ standard contractual clauses or equivalent safeguards, or on your consent where that is the lawful basis.
8. How Long We Keep Your Information
We keep personal data only as long as needed for the purposes in this policy:
Enquiry and client records: while we are actively helping you, and afterwards for a reasonable period in case you return to the market, unless you ask us to delete them sooner.
Transaction and due-diligence records: for at least five years after the transaction, as required by Panama’s anti-money-laundering law (Law 23 of 2015), and longer if another law requires it.
Newsletter data: until you unsubscribe.
Website analytics data: according to the retention settings of Wix and Google.
When data is no longer needed, we delete it or make it anonymous.
9. Your Rights
Under Panamanian law you have the right to:
Access the personal data we hold about you.
Rectification of data that is inaccurate or incomplete.
Cancellation (deletion) of data that is no longer needed or was processed unlawfully.
Opposition to processing, including withdrawing your consent at any time.
Portability of data you gave us, in a structured, commonly used format.
If you live in the European Union, the United Kingdom or another place with its own data protection law, you may have similar or additional rights, such as the right to restrict processing.
To use any of these rights, email ken@panama-properties.com. We may need to confirm your identity before acting on a request, and we will reply within the time required by law. Some data must be kept for legal reasons even after a deletion request. If you are not satisfied with our answer, you can complain to Panama’s National Authority for Transparency and Access to Information (ANTAI) or to the data protection authority where you live.
10. How We Protect Your Information
We use reasonable technical and organisational measures to protect personal data, including encrypted (HTTPS) connections to the Website, access controls and secure service providers. No method of sending or storing data online is completely secure, so we cannot guarantee absolute security. If a data breach is likely to affect your rights, we will notify you and the authorities as required by law.
11. Children
Our services are intended for adults. We do not knowingly collect personal data from anyone under 18. If you believe a minor has given us personal data, please contact us and we will delete it.
12. Links to Other Websites
The Website links to other sites, such as airlines, government offices and our partners. We are not responsible for their content or privacy practices, so please read their privacy policies.
13. Changes to This Policy
We may update this policy from time to time. The “Last updated” date at the top shows when it last changed. If we make significant changes, we will post a notice on the Website.
