1. About These Terms
These Terms of Use govern your use of www.panama-properties.com (the “Website”). By using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website.
2. Who We Are
The Website is operated by Panama Properties, a licensed real estate brokerage in the Republic of Panama, with its office at Unit 1 Plaza Pedasí (Super Pedasí Plaza), Pedasí, Los Santos 7401, Panama. In these Terms, “we”, “us” and “our” mean Panama Properties, and “you” means anyone who uses the Website.
3. General Information Only
The guides, articles, figures and other content on the Website are general information about buying, selling, owning and living in Panama. They are not legal, tax, immigration, financial or investment advice, and they may not reflect the latest changes in law, regulation or market conditions.
Before you make any decision, get advice from qualified professionals, such as a Panamanian attorney, an immigration lawyer, and a tax adviser in your home country. Any figures for prices, costs, taxes, rental income or returns are estimates and are not guaranteed.
4. Property Listings
Listing information comes from sellers, developers and other sources. We work to keep it accurate, but we do not guarantee that it is complete, current or error-free.
Properties may be sold, withdrawn or changed in price at any time without notice. Prices are in US dollars unless stated otherwise.
Measurements, boundaries, lot sizes, features, photos, floor plans and renderings are approximate or illustrative and should be confirmed through your own inspection, survey and legal due diligence.
A listing is an invitation to enquire, not an offer to sell. No agreement exists until a written contract is signed by the parties.
5. Our Services
Contacting us or using the Website does not by itself create a client relationship. When we represent a buyer, the terms of that representation are set out in our written Buyer Agreement. When we represent a seller, the terms are set out in a written listing agreement. If anything in those agreements conflicts with these Terms, the signed agreement applies.
Buyers pay no agent commission to Panama Properties. Your main purchase costs are your own attorney and the usual notary and Public Registry fees.
6. Third-Party Professionals and Services
We may introduce you to attorneys, immigration lawyers, mortgage partners, surveyors, builders, property managers and other providers. They are independent of Panama Properties, and you engage them directly under their own terms. We are not responsible for their advice, services, fees or conduct, and you should make your own checks before hiring anyone.
7. Using the Website
You agree to use the Website only for lawful purposes. You must not:
give false information or impersonate anyone in our forms or messages;
copy, scrape or harvest listings, photos or other content by automated means;
upload or send viruses, malicious code or spam;
try to gain unauthorised access to the Website, its systems or member accounts; or
use the Website in any way that could damage it or interfere with other people’s use of it.
If you create a member account, keep your login details secure. We may suspend or close accounts that break these Terms.
8. Intellectual Property
The Website and its content, including text, guides, photos, videos, graphics, logos and design, are owned by Panama Properties or used under licence, and are protected by copyright and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, republish, sell or otherwise use our content without our written permission. Third-party names and trademarks belong to their owners.
9. What You Send Us
When you send us reviews, testimonials, photos or other material, you confirm that you have the right to share it, and you allow us to use it to provide our services and, with your permission, to publish it on the Website and in our marketing. How we handle your personal data is explained in our Privacy Policy.
10. Links to Other Websites
The Website links to sites and services run by others, such as airlines, government offices, banks and partners. We provide these links for convenience only. We do not control or endorse those sites and are not responsible for their content, accuracy or privacy practices.
11. No Warranties
The Website is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the Website or its content, including that it will be accurate, complete, uninterrupted or free of errors or viruses.
12. Limitation of Liability
To the fullest extent permitted by law, Panama Properties and its directors, agents and staff are not liable for any indirect, incidental or consequential loss, or for any loss of profit, opportunity or data, arising from your use of the Website or reliance on its content. Nothing in these Terms limits liability that cannot be limited under applicable law. Any liability relating to our brokerage services is governed by the written agreement for those services.
13. Indemnity
You agree to compensate Panama Properties for claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the Website.
14. Changes
We may update the Website and these Terms at any time. The “Last updated” date shows when these Terms last changed. Continuing to use the Website after a change means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Republic of Panama. Any dispute about the Website or these Terms will be handled by the competent courts of the Republic of Panama, unless the law of your country gives you a right to bring a claim where you live.
16. General
If any part of these Terms is found invalid, the rest remains in force. If we do not enforce a right straight away, we have not given it up. If these Terms are translated, the English version applies where the versions differ.
